FAA Director of Airspace Services Mr. D.E. Roberts agrees with the Safety Council’s position on Part 101 waivers stating. "There are no special provisions which encompass all parasail operators.”

ORLANDO, FL
- The FAA responds to PSC’s February 2011 petition requesting clarification of CFR 14 part 101 as it relates to mandated Certificates of Wavier under the special provision clause for all parasail operators.   The FAA agreed with our position in its March 15, 2011 response letter, stating. ‘There are no special provisions which encompass all parasail operators, nor are there any current initiatives to modify or change 14 CFR part 101.’  
Now that we have clarified this issue with the FAA.  We strongly advise  Parasail Manufacturers and Associations to remove the FAA Memorandum dated November 09, 2009 detailing a parasail operator's applicability to 14 CFR 101 restrictions which you are now aware is incorrect, as well as the power point presentation prepared by Mr. Peter Avecedo from their websites.
