1975 First Parasail Accident - Lawsuit and Expert Witness BACKGROUND 1975, Gloria R. Hardy brought the first lawsuit to recover damages for injuries she received while using a parasail canopy manufactured by Pioneer Parachutes. She asserted jurisdiction under South Carolina law. Hardy appealed a ruling of the district court that it lacked personal jurisdiction over, Pioneer Parachute Co. and Parachutes, Inc. They concluded that the district court had jurisdiction under both South Carolina's long-arm statute and the federal constitution. Pioneer Parasail hired Mark McCulloh as there expert consultant to review the case which included accident reconstruction videos and testimony. McCulloh, even with his limited experience, was the most knowledgeable person about parasail operations and equipment at the time. The case settled without further proceedings and McCulloh began his career as an expert witness.
