The Blame Game Continues..
Recent
Emails...
: Email 1 "What concerns me with all this information about
Insurance is that future prices will be based on availability not
affordability, is that fair?" PSC Response: Keep
in mind that insurance companies are in the risk business, they don’t
really care about the dysfunctional World of Para-Sailing and will
leverage anything to justify a premium increase.
Email 2 " I am very upset when safe operators like me are
being put in the same fish bowl with unsafe operators who take unnecessary
chances and don't give a s_ _ t about the consequences, like the future
price of insurance!" PSC Response: Forget about blaming
others for the rising insurance rates, they are just a small component of
a very complex formula of the risk vs. reward equation and the legal
consequences after an accident occurs that can effect the future price of
insurance.
Email 3 "Most captains involved in accidents are flying too
high to compete with the others, using old chutes that are faded, mangled
tow lines that look like hell and don’t follow any sort of guidelines or
your proposed rules, how about focusing on those guys paying higher
premiums or the government setting some standards !" PSC
Response: Unfortunately, at this late date not even an organized
Operators Association or Government intervention will be enough, it all
sounds nice but commercial parasailing has a history of being a runaway
train with no one behind the wheel that finally collided with the Insurance
brick wall.
The PSC Strategy to Stabilize the Insurance Market..
A key component of the insurance demise and expected rate increases is
not limited solely to the number of claims made and/or client base, but
rather the historical value placed on past verdicts, settlements, expected
losses and expert’s support of Plaintiffs Attorneys theory on causation.
Simply put, if a panel of experts tells the Plaintiffs Attorneys there is
no case, the Plaintiffs Attorney will try to settle out of court. On the
other hand, if that same panel of experts tells the Plaintiffs Attorney
you have a winner, the Plaintiffs Attorneys will always go for the
juggler.
Unlike any other commercial business enterprises around the World where
there is an abundance of experts to support the Plaintiffs and/or
Defendants side of a case, Parasailing is a niche market supported only by
a handful of qualified experts and the key strategy behind the PSC
proposal to Underwriters by offering them an Expert Witness Team
exclusively for the Insured thus giving their Defense Attorneys a tactical
advantage over the Plaintiffs and leveling-the-playing-field with the hope
to stabilize the future insurance market for Parasailing.
